LINN COUNTY SHERIFF'S OFFICE: CIVIL DIVISION

  CIVIL PROCESS

One statutory responsibility as it relates to the Civil Division is to execute the process and orders of the courts when delivered to the Sheriff for that purpose. Upon receipt of process, order, or paper, the Sheriff must execute or serve them according to its commands and to make a written return on the execution or service to the courts.

There are many types of papers, or civil process, that our office handles. These fall under two categories: Notice Process and Enforcement Process. The function of notice process is to give an individual knowledge of an ongoing legal proceeding and through its service, the court gains jurisdiction over the individual. These papers include Summons, Subpoena, Small Claims, and Restraining Orders.

The function of Enforcement Process is for the Sheriff to carry out the order of the court through the seizure and sale of property, seizure and delivery of personal property, and real property foreclosures.

During fiscal year 2003/2004, the division served over 7,000 documents making over 16,500 contacts, and performed 239 enforcement activities ordered by the court.
